This Article argues that U.S. law should give protection to relationships between cohabitants and their partners’ children when necessary to avoid the economic and emotional trauma that may be caused by separation of the child from a member of his or her household if the cohabitation ends. After examining the social science literature about the welfare of both stepchildren and children of cohabitants and the inadequate legal treatment of custody, visitation, and child support issues under current law, the author recommends (...) that cohabiting stepparents be given standing to seek custody if they have acted as de facto parents, with a presumption in favor of custody by the stepparent when the cohabitant who is the child’s biological parent has died and the possibility of joint custody in other cases; be awarded visitation if both the ex-cohabitant and child desire it; and be obligated to pay child support for the child if the cohabitation dissolves after a period of two years or more. This paper demonstrates how Mary Astell's version of Cartesian dualism supports her disavowal of female subordination and traditional gender roles, her rejection of Locke's notion of “thinking matter” as a major premise for rejecting his political philosophy of “social contracts” between men and women, and, finally, her claim that there is no intrinsic difference between genders in terms of ratiocination, the primary assertion that grants her the title of the first female English feminist.

ABSTRACT The function of the comic in the midst of tragedy is not clear. After all, is it simply comic relief that wounded nations, communities, or individuals seek? Tragedy has long been cast as memory and mourning while comedy offers for the masses a Nietzschean moment of joyful forgetting and for the Stoic mind a measure of transcendence from our grief. The latter view came into prominence for modern American culture with the nineteenth-century satirist Mark Twain, who wrote that “the (...) secret source of humor itself is not joy but sorrow,” which has been interpreted through the often-quoted formula: comedy is tragedy plus time. The assumption is that we need some distance emotionally in order to mock or transcend the tragic. While we grant the humor of transcendence can produce some momentary relief through emotional distance, we wonder if there might be another way that humor can deal with suffering? Popular psychology often speaks of five stages of grief, and while that progression seems too linear and simplistic, we find that the now much more inclusive comic stage has something to offer their audiences struggling to make sense of a volatile world. What happens at the end of a clinical trial for an investigational neural implant? It may be surprising to learn how difficult it is to answer this question. While new trials are initiated with increasing regularity, relatively little consensus exists on how best to conduct them, and even less on how to ethically end them. The landscape of recent neural implant trials demonstrates wide variability of what happens to research participants after an neural implant trial ends. Some former research participants (...) continue to receive support for their devices (e.g., battery and component replacements, software updates, etc.). Others, when safe, have their neural implants removed through surgical explantation. Still others continue to live with a deactivated neural implant embedded in their body. In the United States, there are no uniform requirements to provide services, of any kind, after an neural implant study ends, and other nations are similarly facing this challenge. The existence of a post-trial gap in an expanding neural implant research ecosystem invites obvious questions: What is owed to neural implant research participants post-trial, and why has providing it been so difficult to accomplish in practice? To take a step forward on this difficult issue, we assembled one group of stakeholders – researchers funded for neuroethics grants by the National Institutes of Health – to explore possible starting points on one topic: ethical guidance for post-trial care of research participants in neural implant trials. Based on shared concerns discussed in the expert workshop the current paper is a call to action. It reports the key areas of convergence from the meeting and highlights important next steps towards developing much needed guidance. (shrink)

BackgroundAustralian health and medical research funders support substantial research efforts, and incentives within grant funding schemes influence researcher behaviour. We aimed to determine to what extent Australian health and medical funders incentivise responsible research practices.MethodsWe conducted an audit of instructions from research grant and fellowship schemes. Eight national research grants and fellowships were purposively sampled to select schemes that awarded the largest amount of funds. The funding scheme instructions were assessed against 9 criteria to determine to what extent (...) they incentivised these responsible research and reporting practices: publicly register study protocols before starting data collection, register analysis protocols before starting data analysis, make study data openly available, make analysis code openly available, make research materials openly available, discourage use of publication metrics, conduct quality research, collaborate with a statistician, and adhere to other responsible research practices. Each criterion was answered using one of the following responses: “Instructed”, “Encouraged”, or “No mention”.ResultsAcross the 8 schemes from 5 funders, applicants were instructed or encouraged to address a median of 4 of the 9 criteria. Three criteria received no mention in any scheme. Importantly, most incentives did not seem strong as applicants were only instructed to register study protocols, discourage use of publication metrics and conduct quality research. Other criteria were encouraged but were not required.ConclusionsFunders could strengthen the incentives for responsible research practices by requiring grant and fellowship applicants to implement these practices in their proposals. Administering institutions could be required to implement these practices to be eligible for funding. Strongly rewarding researchers for implementing robust research practices could lead to sustained improvements in the quality of health and medical research. (shrink)

Externalism in the philosophy of mind has been thought by many to pose a serious threat to the claim that subjects are in general authoritative with regard to certain of their own intentional states.¹ In a series of papers, Tyler Burge (1985_a_, 1985_b_, 1988, 1996) has argued that the distinctive entitlement or right that subjects have to self- knowledge in certain cases is compatible with externalism, since that entitlement is environmentally neutral, neutral with respect to the issue of the individuation (...) dependence of subjects' intentional states on factors beyond their bodies. His reason is that whereas externalism—the view that certain intentional states of persons are individuation-dependent on objects and/or phenomena external to their bodies—is a metaphysical thesis, authoritative self-knowledge is an epistemological matter. This being so, there is no reason to suppose that the two need conflict with one another. (shrink)

Faculty members in science, technology, engineering, and mathematics disciplines are typically expected to pursue grant funding and publish to support their research or teaching agendas. Providing effective professional development programs on grant preparation and management and on research publications is crucial. This study shares the design and implementation of such a program for Native STEM faculty from two tribal colleges and one public, non-tribal, Ph.D. granting institution during a 3-year period. The overall development and implementation of the program (...) is centered on the six R’s Indigenous framework – Respect, Relationship, Representation, Relevance, Responsibility, and Reciprocity. The role of NAF-STEM and their interactions with the program, as members of the community formed by their participation, impacted the program. Their practices and the program co-emerged over time, each providing structure and meaning for the other. Through such reciprocity, NAF-STEM and the program research team continually refined the program through their mutual engagement. They took on the shared responsibility of the program while they participated in and shaped its practices. The process and results of formative and summative assessment and the impact of COVID-19 on the program are reported. Results of the program offer lessons on the implementation of six R’s framework in professional development at institutions of higher education. (shrink)

In this paper I outline and defend an introspectionist account of authoritative self-knowledge for a certain class of cases, ones in which a subject is both thinking and thinking about a current, conscious thought. My account is distinctive in a number of ways, one of which is that it is compatible with the truth of externalism.

‘Introspection’ is a term used by philosophers to refer to a special method or means by which one comes to know certain of one's own mental states; specifically, one's current conscious states. It derives from the Latin ‘spicere’, meaning ‘look’, and ‘intra’, meaning ‘within’; introspection is a process of looking inward. Introspectionist accounts of self-knowledge fall within the broader domain of theories of self-knowledge, understood as views about the nature of and basis for one's knowledge of one's own mental states, (...) including one's beliefs, desires, conscious thinkings, and sensations. Theories of self-knowledge are motivated by the apparent need to account for a number of striking features of at least some such knowledge, which ordinary empirical knowledge, including knowledge of the mental states of others, is typically thought to lack. ‘Neuroethics’ is a term which has come into use in the last few years, and which is variously defined. In the Preface to his book, Grant Gillett indicates the sense in which he is using it: the central questions in neuroethics, he says, are those of ‘human identity, consciousness and moral responsibility or the problem of the will’. His aim is to offer an account of human identity which can shed light on issues both in general philosophy and in (...) bioethics.The question which this account seeks to answer is stated in various ways in the book, but perhaps the simplest formulation is this: what is the difference between being somebody and being some body? The Cartesian answer, that the difference lies in the possession of an immaterial thinking substance, is rejected on the grounds that a thinking thing cannot be only a thinking thing: to think is to respond to the world in various ways, which requires bodily means of response. There is mounting evidence that methylphenidate (MPH; Ritalin) is being used by healthy college students to improve concentration, alertness, and academic performance. One of the key concerns associated with such use of pharmaceuticals is the degree of freedom individuals have to engage in or abstain from cognitive enhancement (CE). From a pragmatic perspective, careful examination of the ethics of acts and contexts in which they arise includes considering coercion and social pressures to enhance cognition. We were interested in understanding how (...) university students, parents of university students, and healthcare providers viewed autonomy and coercion in CE using MPH. We found that perspectives converged on the belief that CE is a matter of personal and individual choice. Perspectives also converged on the existence of tremendous social pressures to perform and succeed. Parents emphasized personal responsibility and accountability for CE choices, and expressed feelings of worry, sadness and fear about CE. Students emphasized the importance of personal integrity in CE, expressed tolerance for personal choices of others, and highlighted the challenge that CE poses to maintaining one’s personal integrity. Healthcare providers emphasized the health consequences of CE. These results illustrate: (1) the importance of understanding how context is viewed in relation to perspectives on autonomous choice; (2) the limitations of individualistic libertarian approaches that do not consider social context; and (3) the ethical implications of public health interventions in a value-laden debate where perspectives diverge. Forgetting, as Tacitus knew to his cost, (...) cannot be done to order, whether the order be one's own or another's. Erasure, rather. Indeed erasures of a wide variety, from official memory sanctions mandating the removal of names from inscriptions and imagines from funerals, to spontaneous erasures on or of monuments associated with the disgraced, to literary attacks targeting posthumous reputations. The emphasis is on the first category; the book is structured around a chronological survey of official memory sanctions and the physical traces thereof from the early Republic [End Page 599] up to the first year of the principate of Antoninus Pius, but the other types are well integrated into the discussion. The Art of Forgetting is a fascinating study of the battle between the living and the dead or disgraced for prime turf in the memory space of the Roman elite.As with so much of Roman history as we can know it, the "memory wars" and "memory games" treated in this book are an elite phenomenon. The erasures discussed (and, happily, often pictured) here are most accessible to us when they are accomplished in the same enduring media to which the Roman elite entrusted its public record and reputation. The title of Flower's first chapter, "Clementis' Hat," alluding to the chance survival of a photographic testimonial for Czech politician Vladimir Clementis, captures Flower's early assertion that we can only know the incompletely successful erasures (12), but this seems to me to collapse an essential distinction, preserved elsewhere in the book, including its subtitle, between memory and reputation. The senate-mandated erasure of the man accused of Germanicus' murder is accomplished both by chiseling his name out of the dedication of a statue of Germanicus and by chiseling it into the empire-wide inscriptions on which the senate's verdict in his trial was recorded. The former deprives him of prime memory space; the latter assigns him space on the wrong side of the tracks, so to speak. Both oblivion and disgrace are weapons in the memory wars, and their relative salience varies.The chronological survey of the Roman evidence is preceded by a contextualizing chapter on memory sanctions in the Greek world, particularly in the Hellenistic world, in which Rome's elite saw first hand the battles over what went into the monumental record that followed (or even preceded) battles for territory. Early-attested sanctions such as the razing of a disgraced person's house seem to combine practical and symbolic ends: displacement of the individual and his immediate family and erasure of an avatar. The record of sanctions in democratic Athens, which adds to house-razing the expulsion of remains and the erection of stelai publicizing the names and crimes of offenders against the demos, already shows the complementary effects of oblivion and disgrace later exploited at Rome. A helpful distinction is drawn between amnesties such as that of 403 B.C.E. Athens, in which "a new start was made by promising not to use the past as a political weapon" (23), and the kind of memory politics manifested in sanctions. The discussion of the Hellenistic world establishes the connection, later relevant to the treatment of Rome's imperial women, between extravagant honors and harsh penalties in the symbolic realm: in the rhetoric of relations between cities and kings, for example, a ruler in favor is honored as a god, while a ruler out of favor may find his cult appropriated, his record erased, and his memory cursed.Rome had its own long-standing traditions of memory sanctions. This paper considers Grotius's emendations to the text of Tacitus in his 1640 Notae et emendationes, with a particular emphasis on those passages in which Grotius has made a lasting contribution to our understanding of the ancient author: An. 1.32.3, 6.3.1, 11.14.3, 15.47.1, H. 2.1.2, Ag. 10.5, 46.2. It also argues that in four further passages his contribution deserves to loom a little larger in the text, or at least in the apparatus criticus, of Tacitus's works than it presently does. (...) This paper defends a qualified observational model of authoritative self‐knowledge, which centres on two features of ordinarily observable characteristics that help explain a subject's direct awareness of them. The first is that they are basic, in that one does not have to know of any underlying fact in virtue of which they apply when they do; and the second is that it is generally necessary and sufficient for the application of such a characteristic that it seems to a normal observer, (...) in normal circumstances, that it does apply. The view is defended against two well‐known misgivings about modelling such knowledge on observation: first, that there is a telling structural disanalogy, since observation normally involves three components, namely, the item perceived, an intermediary, non‐conceptual sensation state, and a judgement grounded in that sensation state, whereas self‐knowledge of an intentional state apparently involves analogues of the first and third components only, namely, a first‐order content‐bearing state and the second‐order state that it validates; and second that, whereas the relations between a perceptual state and the item perceived are causal and contingent, those between first‐ and corresponding second‐order intentional states are in general non‐contingent, and so not merely causal.
